Article 1?This Law is developed in accordance with the Constitution for the purposes of preventing food waste, safeguarding national food security, promoting the traditional virtues of the Chinese nation, practicing the core socialist values, conserving resources, protecting the environment, and promoting sustainable economic and social development. 第一條??為了防止食品浪費(fèi),保障國(guó)家糧食安全,弘揚(yáng)中華民族傳統(tǒng)美德,踐行社會(huì)主義核心價(jià)值觀,節(jié)約資源,保護(hù)環(huán)境,促進(jìn)經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展,根據(jù)憲法,制定本法。
Article 2?The food referred to in this Law means the food provided in the?Food Safety Law of the People’s Republic of China, including all kinds of food for human consumption or drinking. 第二條??本法所稱食品,是指《中華人民共和國(guó)食品安全法》規(guī)定的食品,包括各種供人食用或者飲用的食物。
Food waste referred to in this Law refers to the failure to use food that is safe to eat or drink in accordance with its functional purpose, including waste and the reduction in quantity or quality of food due to unreasonable use. 本法所稱食品浪費(fèi),是指對(duì)可安全食用或者飲用的食品未能按照其功能目的合理利用,包括廢棄、因不合理利用導(dǎo)致食品數(shù)量減少或者質(zhì)量下降等。
Article 3?The state practices economy and opposes waste. 第三條??國(guó)家厲行節(jié)約,反對(duì)浪費(fèi)。
The state takes technically feasible and economically reasonable measures to prevent and reduce food waste in accordance with the principles of multiple measures, targeted policies, effective management, and public participation. 國(guó)家堅(jiān)持多措并舉、精準(zhǔn)施策、科學(xué)管理、社會(huì)共治的原則,采取技術(shù)上可行、經(jīng)濟(jì)上合理的措施防止和減少食品浪費(fèi)。
The state calls for?socially responsible, healthy,?resource-saving,?and?environmentally friendly?ways of consumer spending and?advocates a simple, moderate, eco-friendly and low-carbon lifestyle. 國(guó)家倡導(dǎo)文明、健康、節(jié)約資源、保護(hù)環(huán)境的消費(fèi)方式,提倡簡(jiǎn)約適度、綠色低碳的生活方式。
Article 4?People’s governments at all levels shall strengthen the leadership over food waste?reduction?work, define food waste?reduction?goals and tasks, establish sound anti-food waste work mechanisms, organize food waste monitoring, investigation, analysis and evaluation, strengthen regulation, and advance food waste?reduction?work. 第四條??各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)對(duì)反食品浪費(fèi)工作的領(lǐng)導(dǎo),確定反食品浪費(fèi)目標(biāo)任務(wù),建立健全反食品浪費(fèi)工作機(jī)制,組織對(duì)食品浪費(fèi)情況進(jìn)行監(jiān)測(cè)、調(diào)查、分析和評(píng)估,加強(qiáng)監(jiān)督管理,推進(jìn)反食品浪費(fèi)工作。
Local people’s governments at or above the county level shall annually publicize the work progress in reducing food waste, propose measures to strengthen efforts in this field, and continue to promote food waste?reduction?throughout society. 縣級(jí)以上地方人民政府應(yīng)當(dāng)每年向社會(huì)公布反食品浪費(fèi)情況,提出加強(qiáng)反食品浪費(fèi)措施,持續(xù)推動(dòng)全社會(huì)反食品浪費(fèi)。
Article 5?The development and reform authorities under the State Council shall strengthen the organization and coordination of efforts against food waste nationwide, and, in conjunction with other relevant authorities under the State Council, analyze and assess the food waste situation each year, make overall plans for reducing food waste, and adopt measures and guidelines for implementation by competent authorities. 第五條??國(guó)務(wù)院發(fā)展改革部門應(yīng)當(dāng)加強(qiáng)對(duì)全國(guó)反食品浪費(fèi)工作的組織協(xié)調(diào);會(huì)同國(guó)務(wù)院有關(guān)部門每年分析評(píng)估食品浪費(fèi)情況,整體部署反食品浪費(fèi)工作,提出相關(guān)工作措施和意見,由各有關(guān)部門落實(shí)。
The commerce authorities under the State Council shall strengthen the management of the catering industry, and establish sound industry standards and service specifications, and, in conjunction with the market regulation authorities and other authorities under the State Council, establish anti-food waste systems and norms for the catering industry, take measures to encourage catering service operators to provide?individual meal?services and disclose their practice of minimizing food waste. 國(guó)務(wù)院商務(wù)主管部門應(yīng)當(dāng)加強(qiáng)對(duì)餐飲行業(yè)的管理,建立健全行業(yè)標(biāo)準(zhǔn)、服務(wù)規(guī)范;會(huì)同國(guó)務(wù)院市場(chǎng)監(jiān)督管理部門等建立餐飲行業(yè)反食品浪費(fèi)制度規(guī)范,采取措施鼓勵(lì)餐飲服務(wù)經(jīng)營(yíng)者提供分餐服務(wù)、向社會(huì)公開其反食品浪費(fèi)情況。
The market regulation authorities under the State Council shall strengthen the anti-food waste regulation on food producers and operators and urge them to implement anti-food waste measures. 國(guó)務(wù)院市場(chǎng)監(jiān)督管理部門應(yīng)當(dāng)加強(qiáng)對(duì)食品生產(chǎn)經(jīng)營(yíng)者反食品浪費(fèi)情況的監(jiān)督,督促食品生產(chǎn)經(jīng)營(yíng)者落實(shí)反食品浪費(fèi)措施。
The national food and strategic reserves authorities shall make grain storage and circulation more food-saving and loss-reducing, and in conjunction with relevant authorities under the State Council, organize the implementation of food storage, transportation, and processing standards. 國(guó)家糧食和物資儲(chǔ)備部門應(yīng)當(dāng)加強(qiáng)糧食倉(cāng)儲(chǔ)流通過程中的節(jié)糧減損管理,會(huì)同國(guó)務(wù)院有關(guān)部門組織實(shí)施糧食儲(chǔ)存、運(yùn)輸、加工標(biāo)準(zhǔn)。
Relevant authorities under the State Council shall carry out anti-food waste work in accordance with this Law and their respective responsibilities defined by the State Council. 國(guó)務(wù)院有關(guān)部門依照本法和國(guó)務(wù)院規(guī)定的職責(zé),采取措施開展反食品浪費(fèi)工作。
Article 6?Government?organs, people’s organizations, state-owned enterprises, and public institutions shall specify?and improve?the?standards?for official receptions, meetings, training sessions and other official activities in accordance with relevant state regulations, strengthen administration, and take the lead in saving food and opposing waste. 第六條??機(jī)關(guān)、人民團(tuán)體、國(guó)有企業(yè)事業(yè)單位應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定,細(xì)化完善公務(wù)接待、會(huì)議、培訓(xùn)等公務(wù)活動(dòng)用餐規(guī)范,加強(qiáng)管理,帶頭厲行節(jié)約,反對(duì)浪費(fèi)。
Where meals are required for official activities, the number and form of meals shall be arranged according to the actual situation, and shall not exceed the prescribed standards. 公務(wù)活動(dòng)需要安排用餐的,應(yīng)當(dāng)根據(jù)實(shí)際情況,節(jié)儉安排用餐數(shù)量、形式,不得超過規(guī)定的標(biāo)準(zhǔn)。
Article 7?Catering service providers shall take the following measures to prevent food waste: 第七條??餐飲服務(wù)經(jīng)營(yíng)者應(yīng)當(dāng)采取下列措施,防止食品浪費(fèi):
(1) establish sound food purchase, storage, and processing management systems, strengthen the vocational training of service personnel, and incorporate saving food and avoiding food waste into the training content; (一)建立健全食品采購(gòu)、儲(chǔ)存、加工管理制度,加強(qiáng)服務(wù)人員職業(yè)培訓(xùn),將珍惜糧食、反對(duì)浪費(fèi)納入培訓(xùn)內(nèi)容;
(2)?take the initiative to remind?customers?to prevent food waste, post or place anti-food waste signs in prominent locations, or have service staff give instructions or explanations to guide?customers?to order the right amount of food as needed; (二)主動(dòng)對(duì)消費(fèi)者進(jìn)行防止食品浪費(fèi)提示提醒,在醒目位置張貼或者擺放反食品浪費(fèi)標(biāo)識(shí),或者由服務(wù)人員提示說明,引導(dǎo)消費(fèi)者按需適量點(diǎn)餐;
(3)?improve the quality of catering supply, make food in accordance with standards and specifications, reasonably determine quantities and portions, and provide different?portion size?options such as smaller portions; (三)提升餐飲供給質(zhì)量,按照標(biāo)準(zhǔn)規(guī)范制作食品,合理確定數(shù)量、分量,提供小份餐等不同規(guī)格選擇;
(4) in case of group dining services, incorporate the concept of preventing food waste into the menu design, and prepare dishes and staples reasonably in accordance with the number of diners; and (四)提供團(tuán)體用餐服務(wù)的,應(yīng)當(dāng)將防止食品浪費(fèi)理念納入菜單設(shè)計(jì),按照用餐人數(shù)合理配置菜品、主食;
(5) in case of buffet services, take the initiative to inform diners of the consumption rules and requirements for preventing food waste, provide different sizes of tableware, and remind?customers?to take the?appropriate?amount of food. (五)提供自助餐服務(wù)的,應(yīng)當(dāng)主動(dòng)告知消費(fèi)規(guī)則和防止食品浪費(fèi)要求,提供不同規(guī)格餐具,提醒消費(fèi)者適量取餐。
Catering service operators shall not deceive or mislead diners to overorder. 餐飲服務(wù)經(jīng)營(yíng)者不得誘導(dǎo)、誤導(dǎo)消費(fèi)者超量點(diǎn)餐。
Catering service operators may enrich the menu information by specifying food weight,?the portion size, and recommended number of diners on the menu, give them ordering tips, and provide public spoons and chopsticks, and doggy bags as required. 餐飲服務(wù)經(jīng)營(yíng)者可以通過在菜單上標(biāo)注食品分量、規(guī)格、建議消費(fèi)人數(shù)等方式充實(shí)菜單信息,為消費(fèi)者提供點(diǎn)餐提示,根據(jù)消費(fèi)者需要提供公勺公筷和打包服務(wù)。
Catering service operators may reward diners who participate in the Clean Plate Campaign; they may also charge?customers?who cause obvious waste the corresponding fees for handling food waste at clearly stated rates. 餐飲服務(wù)經(jīng)營(yíng)者可以對(duì)參與“光盤行動(dòng)”的消費(fèi)者給予獎(jiǎng)勵(lì);也可以對(duì)造成明顯浪費(fèi)的消費(fèi)者收取處理廚余垃圾的相應(yīng)費(fèi)用,收費(fèi)標(biāo)準(zhǔn)應(yīng)當(dāng)明示。
Catering service operators may use information technology to analyze dining needs and develop central kitchens and distribution centers to carry out effective management of food procurement, transportation, storage, and processing. 餐飲服務(wù)經(jīng)營(yíng)者可以運(yùn)用信息化手段分析用餐需求,通過建設(shè)中央廚房、配送中心等措施,對(duì)食品采購(gòu)、運(yùn)輸、儲(chǔ)存、加工等進(jìn)行科學(xué)管理。
Article 8?Organizations that have cafeterias shall establish sound cafeteria meal management systems, develop and implement measures to prevent food waste, and strengthen?publicity?and education to increase public awareness against food waste. 第八條??設(shè)有食堂的單位應(yīng)當(dāng)建立健全食堂用餐管理制度,制定、實(shí)施防止食品浪費(fèi)措施,加強(qiáng)宣傳教育,增強(qiáng)反食品浪費(fèi)意識(shí)。
These cafeterias shall strengthen the dynamic management of food purchase, storage, and processing, purchase food and prepare and?serve?meals in accordance with the number of potential diners, improve the utilization rate of raw materials and cooking skills, provide food in accordance with the principles of promoting good health, practicing economy, and following standards, and focus on dietary balance. 單位食堂應(yīng)當(dāng)加強(qiáng)食品采購(gòu)、儲(chǔ)存、加工動(dòng)態(tài)管理,根據(jù)用餐人數(shù)采購(gòu)、做餐、配餐,提高原材料利用率和烹飪水平,按照健康、經(jīng)濟(jì)、規(guī)范的原則提供飲食,注重飲食平衡。
These cafeterias shall improve the way meals are served,?post or place in prominent positions anti-food waste signs to guide the diners to order and take meals in moderate portions,?and?promptly remind?diners of?food waste?behaviors?to amend such behaviors. 單位食堂應(yīng)當(dāng)改進(jìn)供餐方式,在醒目位置張貼或者擺放反食品浪費(fèi)標(biāo)識(shí),引導(dǎo)用餐人員適量點(diǎn)餐、取餐;對(duì)有浪費(fèi)行為的,應(yīng)當(dāng)及時(shí)予以提醒、糾正。
Article 9?Schools shall monitor, analyze and evaluate the number and composition of the diners, and strengthen the management of the catering service in school cafeterias. Schools which use off-campus meal providers shall establish sound mechanisms for selecting and changing meal providers on a merit basis. 第九條??學(xué)校應(yīng)當(dāng)對(duì)用餐人員數(shù)量、結(jié)構(gòu)進(jìn)行監(jiān)測(cè)、分析和評(píng)估,加強(qiáng)學(xué)校食堂餐飲服務(wù)管理;選擇校外供餐單位的,應(yīng)當(dāng)建立健全引進(jìn)和退出機(jī)制,擇優(yōu)選擇。
School cafeterias and off-campus meal providers shall refine their management process, provide meals according to demand, improve the way meals are provided,?serve?science-based and nutritional meals, diversify?portion sizes?and taste options, collect feedbacks of diners regularly, and ensure the quality of dishes and staples. 學(xué)校食堂、校外供餐單位應(yīng)當(dāng)加強(qiáng)精細(xì)化管理,按需供餐,改進(jìn)供餐方式,科學(xué)營(yíng)養(yǎng)配餐,豐富不同規(guī)格配餐和口味選擇,定期聽取用餐人員意見,保證菜品、主食質(zhì)量。
Article 10?Catering takeaway platforms should remind customers in a noticeable way to order in moderation. Where a catering service operator provides services through a catering takeaway platform, it shall provide customers with information such as food portions, specifications or the recommended number of diners on the platform page. 第十條??餐飲外賣平臺(tái)應(yīng)當(dāng)以顯著方式提示消費(fèi)者適量點(diǎn)餐。餐飲服務(wù)經(jīng)營(yíng)者通過餐飲外賣平臺(tái)提供服務(wù)的,應(yīng)當(dāng)在平臺(tái)頁(yè)面上向消費(fèi)者提供食品分量、規(guī)格或者建議消費(fèi)人數(shù)等信息。
Article 11?Tour operators shall encourage tourists to have socially responsible and healthy dining behaviors. Travel agencies and tour guides shall make well-considered arrangements for group meals, and remind tourists to order and take meals in moderation. Relevant industries shall include tour operators’ efforts to discourage food waste in the indicators for relevant quality standard rating. 第十一條??旅游經(jīng)營(yíng)者應(yīng)當(dāng)引導(dǎo)旅游者文明、健康用餐。旅行社及導(dǎo)游應(yīng)當(dāng)合理安排團(tuán)隊(duì)用餐,提醒旅游者適量點(diǎn)餐、取餐。有關(guān)行業(yè)應(yīng)當(dāng)將旅游經(jīng)營(yíng)者反食品浪費(fèi)工作情況納入相關(guān)質(zhì)量標(biāo)準(zhǔn)等級(jí)評(píng)定指標(biāo)。
Article 12?Supermarkets, shopping malls and other food operators shall strengthen daily inspection of their food business, manage the near-expired foods by type, put special marks on them or display and sell them in designated areas. 第十二條??超市、商場(chǎng)等食品經(jīng)營(yíng)者應(yīng)當(dāng)對(duì)其經(jīng)營(yíng)的食品加強(qiáng)日常檢查,對(duì)臨近保質(zhì)期的食品分類管理,作特別標(biāo)示或者集中陳列出售。
Article 13?People’s governments at all levels and their relevant departments shall take measures to oppose extravagance and waste, encourage and promote socially responsible and frugal activities, and develop an atmosphere whereby waste is shameful and frugality is virtuous. 第十三條??各級(jí)人民政府及其有關(guān)部門應(yīng)當(dāng)采取措施,反對(duì)鋪張浪費(fèi),鼓勵(lì)和推動(dòng)文明、節(jié)儉舉辦活動(dòng),形成浪費(fèi)可恥、節(jié)約為榮的氛圍。
Where there is a need for dining during weddings, funerals, gatherings with friends and family, and business activities, organizers and participants shall prepare or order moderate meals and dine in a socially responsible and healthy manner. 婚喪嫁娶、朋友和家庭聚會(huì)、商務(wù)活動(dòng)等需要用餐的,組織者、參加者應(yīng)當(dāng)適度備餐、點(diǎn)餐,文明、健康用餐。
Article 14?Individuals shall pursue socially responsible, healthy, rational, and green consumption. When eating out, they shall order and take food reasonably according to their health conditions, eating habits, and dining needs. 第十四條??個(gè)人應(yīng)當(dāng)樹立文明、健康、理性、綠色的消費(fèi)理念,外出就餐時(shí)根據(jù)個(gè)人健康狀況、飲食習(xí)慣和用餐需求合理點(diǎn)餐、取餐。
In family life, families and their members shall cultivate and form science-proved and healthy habits that make the best use of food and prevent waste, and purchase, store and prepare food according to the actual needs of daily life. 家庭及成員在家庭生活中,應(yīng)當(dāng)培養(yǎng)形成科學(xué)健康、物盡其用、防止浪費(fèi)的良好習(xí)慣,按照日常生活實(shí)際需要采購(gòu)、儲(chǔ)存和制作食品。
Article 15?The state shall improve the standards for producing, storing, transporting, and processing food and other edible agricultural products, promote the use of new technologies, new techniques, and new equipment, guide moderate processing and comprehensive utilization, and reduce losses. 第十五條??國(guó)家完善糧食和其他食用農(nóng)產(chǎn)品的生產(chǎn)、儲(chǔ)存、運(yùn)輸、加工標(biāo)準(zhǔn),推廣使用新技術(shù)、新工藝、新設(shè)備,引導(dǎo)適度加工和綜合利用,降低損耗。
Food producers and operators shall take measures to improve food storage, transportation, and processing conditions to prevent food spoilage, reduce food losses during storage and transport, improve food processing and utilization, and avoid overprocessing and excessive use of raw materials. 食品生產(chǎn)經(jīng)營(yíng)者應(yīng)當(dāng)采取措施,改善食品儲(chǔ)存、運(yùn)輸、加工條件,防止食品變質(zhì),降低儲(chǔ)存、運(yùn)輸中的損耗;提高食品加工利用率,避免過度加工和過量使用原材料。
Article 16?When formulating and revising relevant national, industrial and local standards, prevention of food waste shall be taken as an important consideration. Waste shall be prevented to the maximum extent on the premise of ensuring food safety. 第十六條??制定和修改有關(guān)國(guó)家標(biāo)準(zhǔn)、行業(yè)標(biāo)準(zhǔn)和地方標(biāo)準(zhǔn),應(yīng)當(dāng)將防止食品浪費(fèi)作為重要考慮因素,在保證食品安全的前提下,最大程度防止浪費(fèi)。
Food shelf life shall be set scientifically and reasonably, marked prominently and made easily identifiable. 食品保質(zhì)期應(yīng)當(dāng)科學(xué)合理設(shè)置,顯著標(biāo)注,容易辨識(shí)。
Article 17?People’s governments at all levels and their relevant departments shall establish supervision and inspection mechanisms against food waste, and promptly urge the rectification of food waste problems identified. 第十七條??各級(jí)人民政府及其有關(guān)部門應(yīng)當(dāng)建立反食品浪費(fèi)監(jiān)督檢查機(jī)制,對(duì)發(fā)現(xiàn)的食品浪費(fèi)問題及時(shí)督促整改。
Where a food producer or operator seriously wastes food in the course of food production or marketing, market regulation authorities, commerce authorities and other authorities under the local people’s government at or above the county level may admonish its legal representative or principal leader. The admonished food producer or operator shall make immediate rectification. 食品生產(chǎn)經(jīng)營(yíng)者在食品生產(chǎn)經(jīng)營(yíng)過程中嚴(yán)重浪費(fèi)食品的,縣級(jí)以上地方人民政府市場(chǎng)監(jiān)督管理、商務(wù)等部門可以對(duì)其法定代表人或者主要負(fù)責(zé)人進(jìn)行約談。被約談的食品生產(chǎn)經(jīng)營(yíng)者應(yīng)當(dāng)立即整改。
Article 18?Government authorities, in conjunction with relevant authorities, shall establish evaluation and notification systems for the effectiveness of food waste?reduction?work in government?organ?cafeterias and incorporate food waste?reduction?into the assessment of energy and resources conservation of government?organs?and the establishment of energy-saving government?organs. 第十八條??機(jī)關(guān)事務(wù)管理部門會(huì)同有關(guān)部門建立機(jī)關(guān)食堂反食品浪費(fèi)工作成效評(píng)估和通報(bào)制度,將反食品浪費(fèi)納入公共機(jī)構(gòu)節(jié)約能源資源考核和節(jié)約型機(jī)關(guān)創(chuàng)建活動(dòng)內(nèi)容。
Article 19?Associations of food and catering industries shall strengthen industry self-discipline, develop and implement food waste?reduction?and other related group standards and industry self-regulatory norms, publicize and popularize food waste prevention knowledge, promote advanced models, guide members to consciously carry out food waste?reduction?activities, and take necessary self-disciplinary measures against members?with?wasteful behaviors. 第十九條??食品、餐飲行業(yè)協(xié)會(huì)等應(yīng)當(dāng)加強(qiáng)行業(yè)自律,依法制定、實(shí)施反食品浪費(fèi)等相關(guān)團(tuán)體標(biāo)準(zhǔn)和行業(yè)自律規(guī)范,宣傳、普及防止食品浪費(fèi)知識(shí),推廣先進(jìn)典型,引導(dǎo)會(huì)員自覺開展反食品浪費(fèi)活動(dòng),對(duì)有浪費(fèi)行為的會(huì)員采取必要的自律措施。
Associations of food and catering industries shall carry out food waste monitoring, strengthen analysis and assessment, and annually publish work progress against food waste and the results of monitoring and assessment, provide support for state?organs?to develop laws, regulations, policies, and standards and conduct research on relevant issues, and accept public supervision. 食品、餐飲行業(yè)協(xié)會(huì)等應(yīng)當(dāng)開展食品浪費(fèi)監(jiān)測(cè),加強(qiáng)分析評(píng)估,每年向社會(huì)公布有關(guān)反食品浪費(fèi)情況及監(jiān)測(cè)評(píng)估結(jié)果,為國(guó)家機(jī)關(guān)制定法律、法規(guī)、政策、標(biāo)準(zhǔn)和開展有關(guān)問題研究提供支持,接受社會(huì)監(jiān)督。
Consumers associations and other consumers organizations shall strengthen consumer education on food consumption, and encourage consumers to form the habits of consciously resisting waste. 消費(fèi)者協(xié)會(huì)和其他消費(fèi)者組織應(yīng)當(dāng)對(duì)消費(fèi)者加強(qiáng)飲食消費(fèi)教育,引導(dǎo)形成自覺抵制浪費(fèi)的消費(fèi)習(xí)慣。
Article 20?Government?organs, people’s organizations, social organizations, enterprises, public institutions, and primary-level self-governance organizations shall incorporate practicing strict economy and combatting waste, as part of the public activities to raise cultural-ethical standards, into relevant role model evaluation systems, local?codes of conduct for citizens and industry regulations,?strengthen anti-food waste education and communication, promote the Clean Plate Campaign, advocate socially responsible, healthy and science-based dining culture, and enhance public awareness against food waste. 第二十條??機(jī)關(guān)、人民團(tuán)體、社會(huì)組織、企業(yè)事業(yè)單位和基層群眾性自治組織應(yīng)當(dāng)將厲行節(jié)約、反對(duì)浪費(fèi)作為群眾性精神文明創(chuàng)建活動(dòng)內(nèi)容,納入相關(guān)創(chuàng)建測(cè)評(píng)體系和各地市民公約、村規(guī)民約、行業(yè)規(guī)范等,加強(qiáng)反食品浪費(fèi)宣傳教育和科學(xué)普及,推動(dòng)開展“光盤行動(dòng)”,倡導(dǎo)文明、健康、科學(xué)的飲食文化,增強(qiáng)公眾反食品浪費(fèi)意識(shí)。
People’s governments at or above the county level and their relevant authorities shall continue to organize anti-food waste?publicity?and education, and make it an important part of the National Food Security Awareness Week. 縣級(jí)以上人民政府及其有關(guān)部門應(yīng)當(dāng)持續(xù)組織開展反食品浪費(fèi)宣傳教育,并將反食品浪費(fèi)作為全國(guó)糧食安全宣傳周的重要內(nèi)容。
Article 21?Education authorities shall guide and urge schools to strengthen anti-food waste education and management. 第二十一條??教育行政部門應(yīng)當(dāng)指導(dǎo)、督促學(xué)校加強(qiáng)反食品浪費(fèi)教育和管理。
Schools shall carry out education on national conditions in accordance with regulations, make practicing strict economy and combating waste part of education and teaching, and in the form of learning, practice, and labor experience, carry out anti-food waste education activities to train students to form the habit of practicing thrift and frugality and saving food. 學(xué)校應(yīng)當(dāng)按照規(guī)定開展國(guó)情教育,將厲行節(jié)約、反對(duì)浪費(fèi)納入教育教學(xué)內(nèi)容,通過學(xué)習(xí)實(shí)踐、體驗(yàn)勞動(dòng)等形式,開展反食品浪費(fèi)專題教育活動(dòng),培養(yǎng)學(xué)生形成勤儉節(jié)約、珍惜糧食的習(xí)慣。
Schools shall establish supervision and inspection mechanisms to prevent food waste and develop and implement appropriate incentives and penalties. 學(xué)校應(yīng)當(dāng)建立防止食品浪費(fèi)的監(jiān)督檢查機(jī)制,制定、實(shí)施相應(yīng)的獎(jiǎng)懲措施。
Article 22?The news media shall?popularize?anti-food waste laws, regulations, standards and knowledge, cover role models, expose waste problems, guide the public to establish the appropriate concept of food consumption, and conduct?media?supervision of food waste. Anti-food waste?publicity?and reporting shall be true and fair. 第二十二條??新聞媒體應(yīng)當(dāng)開展反食品浪費(fèi)法律、法規(guī)以及相關(guān)標(biāo)準(zhǔn)和知識(shí)的公益宣傳,報(bào)道先進(jìn)典型,曝光浪費(fèi)現(xiàn)象,引導(dǎo)公眾樹立正確飲食消費(fèi)觀念,對(duì)食品浪費(fèi)行為進(jìn)行輿論監(jiān)督。有關(guān)反食品浪費(fèi)的宣傳報(bào)道應(yīng)當(dāng)真實(shí)、公正。
The production, release, and dissemination of competitive eating and?binge-eating?programs or audios and videos on food wasting shall be banned. 禁止制作、發(fā)布、傳播宣揚(yáng)量大多吃、暴飲暴食等浪費(fèi)食品的節(jié)目或者音視頻信息。
Where online audio and video service providers find that?a?user has violated the provisions of the preceding paragraph, they shall immediately stop transmitting relevant information. Where the circumstances are serious, they shall stop providing information services. 網(wǎng)絡(luò)音視頻服務(wù)提供者發(fā)現(xiàn)用戶有違反前款規(guī)定行為的,應(yīng)當(dāng)立即停止傳輸相關(guān)信息;情節(jié)嚴(yán)重的,應(yīng)當(dāng)停止提供信息服務(wù)。
Article 23?Civil affairs authorities, market regulation authorities and other authorities under local people’s governments at or above the county level shall establish demand matching mechanisms to guide food producers and operators to donate food to relevant social organizations, welfare institutions, relief agencies and other organizations or individuals on the premise of ensuring food safety. Relevant organizations shall receive and distribute food in a timely manner according to their needs. 第二十三條??縣級(jí)以上地方人民政府民政、市場(chǎng)監(jiān)督管理部門等建立捐贈(zèng)需求對(duì)接機(jī)制,引導(dǎo)食品生產(chǎn)經(jīng)營(yíng)者等在保證食品安全的前提下向有關(guān)社會(huì)組織、福利機(jī)構(gòu)、救助機(jī)構(gòu)等組織或者個(gè)人捐贈(zèng)食品。有關(guān)組織根據(jù)需要,及時(shí)接收、分發(fā)食品。

Article 24?Organizations, households, and individuals that generate food waste shall fulfill the obligations of food waste source reduction in accordance with the law. 第二十四條??產(chǎn)生廚余垃圾的單位、家庭和個(gè)人應(yīng)當(dāng)依法履行廚余垃圾源頭減量義務(wù)。
Article 25?The state shall organize the monitoring of nutritional status and the universalization of nutrition knowledge to guide citizens to form good eating habits and reduce the risk of disease caused by unhealthy diets. 第二十五條??國(guó)家組織開展?fàn)I養(yǎng)狀況監(jiān)測(cè)、營(yíng)養(yǎng)知識(shí)普及,引導(dǎo)公民形成科學(xué)的飲食習(xí)慣,減少不健康飲食引起的疾病風(fēng)險(xiǎn)。
Article 26?People’s governments at or above the county level shall take measures to support scientific research and technological development designed to prevent food waste. 第二十六條??縣級(jí)以上人民政府應(yīng)當(dāng)采取措施,對(duì)防止食品浪費(fèi)的科學(xué)研究、技術(shù)開發(fā)等活動(dòng)予以支持。
Government procurement of relevant goods and services shall be conducive to the prevention of food waste. 政府采購(gòu)有關(guān)商品和服務(wù),應(yīng)當(dāng)有利于防止食品浪費(fèi)。
The state implements a tax policy conducive to the prevention of food waste. 國(guó)家實(shí)行有利于防止食品浪費(fèi)的稅收政策。
Article 27?Organizations and individuals have the right to report to relevant government departments and organs any act of food waste by food producers or operators. The government departments and organs that receive the reports shall deal with them in time in accordance with the law. 第二十七條??任何單位和個(gè)人發(fā)現(xiàn)食品生產(chǎn)經(jīng)營(yíng)者等有食品浪費(fèi)行為的,有權(quán)向有關(guān)部門和機(jī)關(guān)舉報(bào)。接到舉報(bào)的部門和機(jī)關(guān)應(yīng)當(dāng)及時(shí)依法處理。
Article 28?Where, in violation of the provisions of this Law, a catering service operator does not take the initiative to remind diners not to waste food, it shall be ordered to make corrections and given a warning by the market regulation authorities of or a department designated by the local people’s government at or above the county level. 第二十八條??違反本法規(guī)定,餐飲服務(wù)經(jīng)營(yíng)者未主動(dòng)對(duì)消費(fèi)者進(jìn)行防止食品浪費(fèi)提示提醒的,由縣級(jí)以上地方人民政府市場(chǎng)監(jiān)督管理部門或者縣級(jí)以上地方人民政府指定的部門責(zé)令改正,給予警告。
Where, in violation of the provisions of this Law, a catering service operator deceives or misleads diners to overorder and cause obvious waste, it shall be ordered to make corrections and given a warning by the market regulation authorities of or a department designated by the local people’s government at or above the county level. Where it refuses to make corrections, a fine of between RMB1,000 and RMB10,000 shall be imposed on it. 違反本法規(guī)定,餐飲服務(wù)經(jīng)營(yíng)者誘導(dǎo)、誤導(dǎo)消費(fèi)者超量點(diǎn)餐造成明顯浪費(fèi)的,由縣級(jí)以上地方人民政府市場(chǎng)監(jiān)督管理部門或者縣級(jí)以上地方人民政府指定的部門責(zé)令改正,給予警告;拒不改正的,處一千元以上一萬(wàn)元以下罰款。
Where, in violation of the provisions of this Law, a food producer or operator causes a serious waste of food during the production and operation progress, it shall be ordered to make corrections by the market regulation authorities of or a department designated by the local people’s government at or above the county level. Where it refuses to make corrections, a fine of between RMB5,000 and RMB50,000 shall be imposed on it. 違反本法規(guī)定,食品生產(chǎn)經(jīng)營(yíng)者在食品生產(chǎn)經(jīng)營(yíng)過程中造成嚴(yán)重食品浪費(fèi)的,由縣級(jí)以上地方人民政府市場(chǎng)監(jiān)督管理部門或者縣級(jí)以上地方人民政府指定的部門責(zé)令改正,拒不改正的,處五千元以上五萬(wàn)元以下罰款。
Article 29?Where, in violation of the provisions of this Law, an organization having a cafeteria does not develop or implement measures to prevent food waste, it shall be ordered to make corrections and given a warning by a department designated by the local people’s government at or above the county level. 第二十九條??違反本法規(guī)定,設(shè)有食堂的單位未制定或者未實(shí)施防止食品浪費(fèi)措施的,由縣級(jí)以上地方人民政府指定的部門責(zé)令改正,給予警告。
Article 30?Where, in violation of the provisions of this Law, a radio station, television station, or online audio and video service provider produces, releases, disseminates, and promotes competitive eating and?binge-eatingprograms or audios and videos on food wasting shall be ordered by the radio and TV authority and the cyberspace authority, in accordance with their respective responsibilities, to make corrections and given a warning. Where it refuses to make corrections or where the circumstances are serious, a fine of between RMB10,000 and RMB100,000 shall be imposed on it, and it may be ordered to suspend relevant business?or suspend operation?for rectification, and the leaders directly responsible and direct offenders shall be held legally liable in accordance with the law. 第三十條??違反本法規(guī)定,廣播電臺(tái)、電視臺(tái)、網(wǎng)絡(luò)音視頻服務(wù)提供者制作、發(fā)布、傳播宣揚(yáng)量大多吃、暴飲暴食等浪費(fèi)食品的節(jié)目或者音視頻信息的,由廣播電視、網(wǎng)信等部門按照各自職責(zé)責(zé)令改正,給予警告;拒不改正或者情節(jié)嚴(yán)重的,處一萬(wàn)元以上十萬(wàn)元以下罰款,并可以責(zé)令暫停相關(guān)業(yè)務(wù)、停業(yè)整頓,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法追究法律責(zé)任。
Article 31?The provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures shall develop their specific local anti-food waste measures in accordance with their specific circumstances and practical needs. 第三十一條??省、自治區(qū)、直轄市或者設(shè)區(qū)的市、自治州根據(jù)具體情況和實(shí)際需要,制定本地方反食品浪費(fèi)的具體辦法。
Article 32?This Law shall come into force on the date of promulgation. 第三十二條??本法自公布之日起施行。
