Chapter I General Provisions 第一章 總則
Article 1 This Law is enacted, in accordance with the Constitution, for the purposes of protecting the copyright of authors in their literary, artistic and scientific works and the copyright-related rights and interests, of encouraging the creation and dissemination of works which would contribute to the construction of socialist spiritual and material civilization, and of promoting the development and prosperity of the socialist culture and science. 第一條 為保護文學、藝術和科學作品作者的著作權,以及與著作權有關的權益,鼓勵有益于社會主義精神文明、物質文明建設的作品的創(chuàng)作和傳播,促進社會主義文化和科學事業(yè)的發(fā)展與繁榮,根據憲法制定本法。
Article 2 Works of Chinese citizens, legal entities or other organizations, whether published or not, shall enjoy copyright in accordance with this Law 第二條 中國公民、法人或者其他組織的作品,不論是否發(fā)表,依照本法享有著作權。
Any work of a foreigner or stateless person which is eligible to enjoy copyright under an agreement concluded between the country to which the foreigner belongs or in which he has habitual residence and China, or under an internationa1 treaty to which both countries are party, shall be protected in accordance with this Law. 外國人、無國籍人的作品根據其作者所屬國或者經常居住地國同中國簽訂的協(xié)議或者共同參加的國際條約享有的著作權,受本法保護。
Works of foreigners or stateless persons first published in the territory of the People's Republic of China shall enjoy copyright in accordance with this Law. 外國人、無國籍人的作品首先在中國境內出版的,依照本法享有著作權。
Any work of a foreigner who belongs to a country which has not concluded an agreement with China, or which is not a party to an international treaty with China or a stateless person first published in an country which is a party to an international treaty with China, or in such a member state or nonmember state, shall be protected in accordance with this Law. 未與中國簽訂協(xié)議或者共同參加國際條約的國家的作者以及無國籍人的作品首次在中國參加的國際條約的成員國出版的,或者在成員國和非成員國同時出版的,受本法保護。
Article 3 For the purposes of this Law, the term "works" includes works of literature, art, natural science, social science, engineering technology and the like which are expressed in the following forms: 第三條 本法所稱的作品,包括以下列形式創(chuàng)作的文學、藝術和自然科學、社會科學、工程技術等作品:
(1) written works; (一)文字作品;
(2) oral works; (二)口述作品;
(3) musical, dramatic, quyi', choreographic and acrobatic works; (三)音樂、戲劇、曲藝、舞蹈、雜技藝術作品;
(4) works of fine art and architecture; (四)美術、建筑作品;
(5) photographic works; (五)攝影作品;
(6) cinematographic works and works created by virtue of an analogous method of film production; (六)電影作品和以類似攝制電影的方法創(chuàng)作的作品;
(7) drawings of engineering designs, and product designs; maps, sketches and other graphic works and model works; (七)工程設計圖、產品設計圖、地圖、示意圖等圖形作品和模型作品;
(8) computer software; (八)計算機軟件;
(9) other works as provided for in laws and administrative regulations. (九)法律、行政法規(guī)規(guī)定的其他作品。
Article 4 Copyright owners, in exercising their copyright, shall not violate the Constitution or laws or prejudice the public interests. The State shall supervise and manage the publication or distribution of works, in accordance with the law. 第四條 著作權人行使著作權,不得違反憲法和法律,不得損害公共利益。國家對作品的出版、傳播依法進行監(jiān)督管理。
Article 5 This Law shall not be applicable to: 第五條 本法不適用于:
(1) laws; regulations; resolutions, decisions and orders of State organs; other documents of a legislative, administrative or judicial nature; and their official translations; (一)法律、法規(guī),國家機關的決議、決定、命令和其他具有立法、行政、司法性質的文件,及其官方正式譯文;
(2) news on current affairs; and (二)時事新聞;
(3) calendars, numerical tables and forms of general use, and formulas. (三)歷法、通用數表、通用表格和公式。
Article 6 Regulations for the protection of copyright in expressions of folklore shall be established separately by the State Council. 第六條 民間文學藝術作品的著作權保護辦法由國務院另行規(guī)定。
Article 7 The copyright administration department under the State Council shall be responsible for the nationwide administration of copyright. The copyright administration department of the People's Government of each province, autonomous region and municipality directly under the Central Government shall be responsible for the administration of copyright in its administrative region. 第七條 國務院著作權行政管理部門主管全國的著作權管理工作;各省、自治區(qū)、直轄市人民政府的著作權行政管理部門主管本行政區(qū)域的著作權管理工作。
Article 8 The copyright owners and copyright-related right holders may authorize an organization for collective administration of copyright to exercise the copyright or any copyright-related right. After authorization, the organization for collective administration of copyright may, in its own name, claim the right for the copyright owners and copyright-related right holders, and participate, as an interested party, in litigation or arbitration relating to the copyright or copyright-related right. 第八條 著作權人和與著作權有關的權利人可以授權著作權集體管理組織行使著作權或者與著作權有關的權利。著作權集體管理組織被授權后,可以以自己的名義為著作權人和與著作權有關的權利人主張權利,并可以作為當事人進行涉及著作權或者與著作權有關的權利的訴訟、仲裁活動。
The organization for collective administration of copyright is a non-profit organization. Provisions for the mode of its establishment, rights and obligations, collection and distribution of the royalties of copyright licensing, and supervision and administration thereof shall be separately established by the State Council. 著作權集體管理組織是非營利性組織,其設立方式、權利義務、著作權許可使用費的收取和分配,以及對其監(jiān)督和管理等由國務院另行規(guī)定。
Chapter II Copyright 第二章 著作權
Section 1 Copyright Owners and Their Right 第一節(jié) 著作權人及其權利
Article 9 The term "copyright owners" shall include: 第九條 著作權人包括:
(1) authors; (一)作者;
(2) other citizens, legal entities and other organizations enjoying copyright in accordance with this Law. (二)其他依照本法享有著作權的公民、法人或者其他組織。
Article 10 The term "copyright" shall include the following personality rights and property rights: 第十條 著作權包括下列人身權和財產權:
(1) the right of publication, that is, the right to decide whether to make a work available to the public; (一)發(fā)表權,即決定作品是否公之于眾的權利;
(2) the right of authorship, that is, the right to claim authorship and to have the author's name mentioned in connection with the work; (二)署名權,即表明作者身份,在作品上署名的權利;
(3) the right of alteration, that is, the right to alter or authorize others to alter one's work; (三)修改權,即修改或者授權他人修改作品的權利;
(4) the right of integrity, that is, the right to protect one's work against distortion and mutilation; (四)保護作品完整權,即保護作品不受歪曲、篡改的權利;
(5) the right of reproduction, that is, the right to produce one or more copies of a work by printing, photocopying, lithographing, making a sound recording or video recording, duplicating a recording, or duplicating a photographic work or by any other means; (五)復制權,即以印刷、復印、拓印、錄音、錄像、翻錄、翻拍等方式將作品制作一份或者多份的權利;
(6) the right of distribution, that is, the right to make available to the public the original or reproductions of a work though sale or other transfer of ownership; (六)發(fā)行權,即以出售或者贈與方式向公眾提供作品的原件或者復制件的權利;
(7) the right of rental, that is, the right to authorize, with payment, others to temporarily use cinematographic works, works created by virtue of an analogous method of film production, and computer software, except any computer software that is not the main subject matter of rental; (七)出租權,即有償許可他人臨時使用電影作品和以類似攝制電影的方法創(chuàng)作的作品、計算機軟件的權利,計算機軟件不是出租的主要標的的除外;
(8) the right of exhibition, that is, the right to publicly display the original or reproduction of a work of fine art and photography; (八)展覽權,即公開陳列美術作品、攝影作品的原件或者復制件的權利;
(9) the right of performance, that is, the right to publicly perform a work and publicly broadcast the performance of a work by various means; (九)表演權,即公開表演作品,以及用各種手段公開播送作品的表演的權利;
(10) the right of showing, that is, the right to show to the public a work, of fine art, photography, cinematography and any work created by analogous methods of film production through film projectors, over-head projectors or any other technical devices; (十)放映權,即通過放映機、幻燈機等技術設備公開再現美術、攝影、電影和以類似攝制電影的方法創(chuàng)作的作品等的權利;
(11) public a work by wireless means, to communicate to the public a broadcast work by wire or relay means, and to communicate to the public a broadcast work by a loudspeaker or by any other analogous tool used to transmit symbols, sounds or pictures; (十一)廣播權,即以無線方式公開廣播或者傳播作品,以有線傳播或者轉播的方式向公眾傳播廣播的作品,以及通過擴音器或者其他傳送符號、聲音、圖像的類似工具向公眾傳播廣播的作品的權利;
(12) the right of communication of information on networks, that is, the right to communicate to the public a work, by wire or wireless means in such a way that members of the public may access these works from a place and at a time individually chosen by them; (十二)信息網絡傳播權,即以有線或者無線方式向公眾提供作品,使公眾可以在其個人選定的時間和地點獲得作品的權利;
(13) the right of making cinematographic work, that is, the right to fixate a work on a carrier by way of film production or by virtue of an analogous method of film production; (十三)攝制權,即以攝制電影或者以類似攝制電影的方法將作品固定在載體上的權利;
(14) the right of adaptation, that is, the right to change a work to create a new work of originality; (十四)改編權,即改變作品,創(chuàng)作出具有獨創(chuàng)性的新作品的權利;
(15) the right of translation, that is, the right to translate a work in one language into one in another language; (十五)翻譯權,即將作品從一種語言文字轉換成另一種語言文字的權利;
(16) the right of compilation, that is, the right to compile works or parts of works into a new work by reason of the selection or arrangement; and (十六)匯編權,即將作品或者作品的片段通過選擇或者編排,匯集成新作品的權利;
(17) any other rights a copyright owner is entitled to enjoy. (十七)應當由著作權人享有的其他權利。
A copyright owner may authorize another person to exercise the rights under the preceding paragraphs (5) to (17), and receive remuneration pursuant to an agreement or this Law. 著作權人可以許可他人行使前款第(五)項至第(十七)項規(guī)定的權利,并依照約定或者本法有關規(guī)定獲得報酬。
A copyright owner may assign, in part or in whole, the rights under the preceding paragraphs (5) to (17), and receive remuneration pursuant to an agreement or this Law. 著作權人可以全部或者部分轉讓本條第一款第(五)項至第(十七)項規(guī)定的權利,并依照約定或者本法有關規(guī)定獲得報酬。
Section 2 Ownership of Copyright 第二節(jié) 著作權歸屬
Article 11 Except where otherwise provided in this Law, the copyright in a work shall belong to its author. 第十一條 著作權屬于作者,本法另有規(guī)定的除外。
The author of a work is the citizen who has created the Work. 創(chuàng)作作品的公民是作者。
Where a work is created according to the intention and under the supervision and responsibility of a legal entity or other organization, such legal entity or organization shall be deemed to be the author of the work. 由法人或者其他組織主持,代表法人或者其他組織意志創(chuàng)作,并由法人或者其他組織承擔責任的作品,法人或者其他組織視為作者。
The citizen, legal entity or other organization whose name is mentioned in connection with a work shall, in the absence of proof to the contrary, be deemed to be the author of the work. 如無相反證明,在作品上署名的公民、法人或者其他組織為作者。
Article 12 Where a work is created by adaptation, translation, annotation or arrangement of a preexisting work, the copyright in the work thus created shall be enjoyed by the adapter, translator, annotator or arranger, Provided that the exercise of such copyright shall not prejudice the copyright in the original work. 第十二條 改編、翻譯、注釋、整理已有作品而產生的作品,其著作權由改編、翻譯、注釋、整理人享有,但行使著作權時不得侵犯原作品的著作權。
Article 13 Where a work is created jointly by two or more co-authors, the copyright in the work shall be enjoyed jointly by those co-authors. Co-authorship may not be claimed by anyone who has not participated in the creation of the work. 第十三條 兩人以上合作創(chuàng)作的作品,著作權由合作作者共同享有。沒有參加創(chuàng)作的人,不能成為合作作者。
If a work of joint authorship can be separated into independent parts and exploited separately, each co-author shall be entitled to independent copyright in the parts that he has created, provided that the exercise of such copyright shall not prejudice the copyright in the joint work as a whole. 合作作品可以分割使用的,作者對各自創(chuàng)作的部分可以單獨享有著作權,但行使著作權時不得侵犯合作作品整體的著作權。
Article 14 A works created by compilation of several works, parts of works, data that do not constitute a work or other materials and having originality in the selection or arrangement of its contents is a work of compilation. The copyright in a work of compilation shall be enjoyed by the compiler, provided that the exercise of such copyright shall not prejudice the copyright in the preexisting works. 第十四條 匯編若干作品、作品的片段或者不構成作品的數據或者其他材料,對其內容的選擇或者編排體現獨創(chuàng)性的作品,為匯編作品,其著作權由匯編人享有,但行使著作權時,不得侵犯原作品的著作權。
Article 15 The copyright in a cinematographic work and any work created by an analogous method of fl1m production shall be enjoyed by the producer of the work, but the scriptwriter, director, cameraman, lyricist, composer, and other authors thereof shall enjoy the right of authorship in the work, and have the right to receive remuneration pursuant to the contract concluded with the producer. 第十五條 電影作品和以類似攝制電影的方法創(chuàng)作的作品的著作權由制片者享有,但編劇、導演、攝影、作詞、作曲等作者享有署名權,并有權按照與制片者簽訂的合同獲得報酬。
The authors of the screenplay, musical works and other works that are incorporated in a cinematographic work and work created by virtue of an analogous method of film production and can be exploited separately shall be entitled to exercise their copyright independently. 電影作品和以類似攝制電影的方法創(chuàng)作的作品中的劇本、音樂等可以單獨使用的作品的作者有權單獨行使其著作權。
Article 16 A work created by a citizen in the fulfillment of tasks assigned to him by a legal entity or other organization shall be deemed to be a work created in the course of employment. The copyright in such work shall be enjoyed by the author, subject to the provisions of the second paragraph of this Article, provided that the legal entity or other organization shall have a priority right to exploit the work within the scope of its professional activities. During the two years after the completion of the work, the author shall not, without the consent of the legal entity or other organization, authorize a third party to exploit the work in the same way as the legal entity or other organization does. 第十六條 公民為完成法人或者其他組織工作任務所創(chuàng)作的作品是職務作品,除本條第二款的規(guī)定以外,著作權由作者享有,但法人或者其他組織有權在其業(yè)務范圍內優(yōu)先使用。作品完成兩年內,未經單位同意,作者不得許可第三人以與單位使用的相同方式使用該作品。
In any of the following cases the author of a work created in the course of employment shall enjoy the right of authorship, while the legal entity or other organization shall enjoy the other rights included in the copyright and may reward the author: 有下列情形之一的職務作品,作者享有署名權,著作權的其他權利由法人或者其他組織享有,法人或者其他組織可以給予作者獎勵:
(1) drawings of engineering designs and product designs and maps, computer software and other works created in the course of employment mainly with the material and technical resource of the legal entity or other organization and under its responsibility; (一)主要是利用法人或者其他組織的物質技術條件創(chuàng)作,并由法人或者其他組織承擔責任的工程設計圖、產品設計圖、地圖、計算機軟件等職務作品;
(2) works created in the course of employment where the copyright is, in accordance with laws, administrative regulations or contracts, enjoyed by the legal entity or other organization. (二)法律、行政法規(guī)規(guī)定或者合同約定著作權由法人或者其他組織享有的職務作品。
Article 17 The ownership of the copyright in a commissioned work shall be agreed upon in a contract between the commissioning and the commissioned parties. In the absence of a contract or of an explicit agreement in the contract, the copyright in such a work shall belong to the commissioned party. 第十七條 受委托創(chuàng)作的作品,著作權的歸屬由委托人和受托人通過合同約定。合同未作明確約定或者沒有訂立合同的,著作權屬于受托人。
Article 18 The transfer of ownership of the original copy of a work of fine art, or other works, shall not be deemed to include the transfer of the copyright in such work, provided that the right to exhibit the original copy of a work of fine art shall be enjoyed by the owner of such original copy. 第十八條 美術等作品原件所有權的轉移,不視為作品著作權的轉移,但美術作品原件的展覽權由原件所有人享有。
Article 19 Where the copyright in a work belongs to a citizen, the right of exploitation and the rights under Article 10, paragraphs (5) to (17), of this Law in respect of the work shall, after his death, during the term of protection provided for in this Law, be transferred in accordance with the provisions of the Inheritance Law. 第十九條 著作權屬于公民的,公民死亡后,其本法第十條第一款第(五)項至第(十七)項規(guī)定的權利在本法規(guī)定的保護期內,依照繼承法的規(guī)定轉移。
under Articles l0, paragraphs (5) to (l7), of this Law, shall, after the change or the termination of the status of the legal entity or other organization, during the term of protection provided for in this Law, be enjoyed by the succeeding legal entity or other organization which has taken over the former's rights and obligations, or, in the absence of such successor entity or other organization, by the State. 著作權屬于法人或者其他組織的,法人或者其他組織變更、終止后,其本法第十條第一款第(五)項至第(十七)項規(guī)定的權利在本法規(guī)定的保護期內,由承受其權利義務的法人或者其他組織享有;沒有承受其權利義務的法人或者其他組織的,由國家享有。
Section 3 Term of Protection for Rights 第三節(jié) 權利的保護期
Article 20 The rights of authorship, alteration and integrity of an author shall be unlimited in time. 第二十條 作者的署名權、修改權、保護作品完整權的保護期不受限制。
Article 21 The term of protection for the right of publication and the rights referred to in Article l0, paragraphs (5) to (17), of this Law in respect of a work of a citizen shall be the lifetime of the author and fifty years after his death, and expires on 31 December of the fiftieth year after the death of the author. In the case of a work of joint authorship, such term shall expire on 31 December of the fiftieth year after the death of the last surviving author. 第二十一條 公民的作品,其發(fā)表權、本法第十條第一款第(五)項至第(十七)項規(guī)定的權利的保護期為作者終生及其死亡后五十年,截止于作者死亡后第五十年的12月31日;如果是合作作品,截止于最后死亡的作者死亡后第五十年的12月31日。
The term of protection for the right of publication and the rights provided for in Article 10, paragraphs (5) to (17), of this Law in respect of a work where the copyright belongs to a legal entity or other organization or in respect of a work created in the course of employment where the legal entity or other organization enjoys the copyright (except the right of authorship), shall be fifty years, and expires on 31 December of the fiftieth year after the first Publication of such work, provided that any such work that has not been published within t1tty years after the completion of its creation shall no longer be protected under this Law. 法人或者其他組織的作品、著作權(署名權除外)由法人或者其他組織享有的職務作品,其發(fā)表權、本法第十條第一款第(五)項至第(十七)項規(guī)定的權利的保護期為五十年,截止于作品首次發(fā)表后第五十年的12月31日,但作品自創(chuàng)作完成后五十年內未發(fā)表的,本法不再保護。
The term of protection for the right of publication or protection for the right of publication or the rights referred to in Article l0, paragraphs (5) to (17), of this Law in respect of a cinematographic work, a work created by virtue of an analogous method of film production or a photographic work shall be fifty years, and expires on 3l December of the fiftieth year after the first publication of such work, provided that any such work that has not been published within fifty years after the completion of its creation shall no longer be protected under this Law. 電影作品和以類似攝制電影的方法創(chuàng)作的作品、攝影作品,其發(fā)表權、本法第十條第一款第(五)項至第(十七)項規(guī)定的權利的保護期為五十年,截止于作品首次發(fā)表后第五十年的12月31日,但作品自創(chuàng)作完成后五十年內未發(fā)表的,本法不再保護。
Section 4 Limitations on Rights 第四節(jié) 權利的限制
Article 22 In the following cases, a work may be exploited without permission from, and without payment of remuneration to, the copyright owner, provided that the name of the author and the title of the work shall be mentioned and the other rights enjoyed by the copyright owner by virtue of this Law shall not be prejudiced: 第二十二條 在下列情況下使用作品,可以不經著作權人許可,不向其支付報酬,但應當指明作者姓名、作品名稱,并且不得侵犯著作權人依照本法享有的其他權利:
(1) use of a published work for the purposes of the user's own private study, research or self-entertainment; (一)為個人學習、研究或者欣賞,使用他人已經發(fā)表的作品;
(2) appropriate quotation from a published work in one's own work for the purposes of introduction to, or comments on, a work, or demonstration of a point; (二)為介紹、評論某一作品或者說明某一問題,在作品中適當引用他人已經發(fā)表的作品;
(3) reuse or citation, for any unavoidable reason, of a published work in newspapers, periodicals, at radio stations, television stations or any other media for the purpose of reporting current events; (三)為報道時事新聞,在報紙、期刊、廣播電臺、電視臺等媒體中不可避免地再現或者引用已經發(fā)表的作品;
(4) reprinting by newspapers or periodicals, or rebroadcasting by radio stations, television stations, or any other media, of Articles on current issues relating to politics, economics or religion published by other newspapers, periodicals, or broadcast by other radio stations, television stations or any other media except where the author has declared that the reprinting and rebroadcasting is not permitted; (四)報紙、期刊、廣播電臺、電視臺等媒體刊登或者播放其他報紙、期刊、廣播電臺、電視臺等媒體已經發(fā)表的關于政治、經濟、宗教問題的時事性文章,但作者聲明不許刊登、播放的除外;
(5) publication in newspapers or periodicals, or broadcasting by radio stations, television stations or any other media, of a speech delivered at a public gathering, except where the author has declared that the publication or broadcasting is not permitted; (五)報紙、期刊、廣播電臺、電視臺等媒體刊登或者播放在公眾集會上發(fā)表的講話,但作者聲明不許刊登、播放的除外;
(6) translation, or reproduction in a small quantity of copies, of a published work for use by teachers or scientific researchers, in classroom teaching or scientific research, provided that the translation or reproduction shall not be published or distributed; (六)為學校課堂教學或者科學研究,翻譯或者少量復制已經發(fā)表的作品,供教學或者科研人員使用,但不得出版發(fā)行;
(7) use of a published work, within proper scope, by a State organ for the purpose of fulfilling its official duties; (七)國家機關為執(zhí)行公務在合理范圍內使用已經發(fā)表的作品;
(8) reproduction of a work in its collections by a library, archive, memorial hall, museum, art gallery or any similar institution, for the purposes of the display, or preservation of a copy, of the work; (八)圖書館、檔案館、紀念館、博物館、美術館等為陳列或者保存版本的需要,復制本館收藏的作品;
(9) free-of-charge live performance of a published work and said performance neither collects any fees from the members of the public nor pays remuneration to the performers; (九)免費表演已經發(fā)表的作品,該表演未向公眾收取費用,也未向表演者支付報酬;
(10) copying, drawing, photographing or video recording of an artistic work located or on display in an outdoor public place; (十)對設置或者陳列在室外公共場所的藝術作品進行臨摹、繪畫、攝影、錄像;
(11) translation of a published work of a Chinese citizen, legal entity or any other organization from the Han language into any minority nationality language for publication and distribution within the country; and (十一)將中國公民、法人或者其他組織已經發(fā)表的以漢語言文字創(chuàng)作的作品翻譯成少數民族語言文字作品在國內出版發(fā)行;
(12) transliteration of a published work into Braille and publication of the work so transliterated. (十二)將已經發(fā)表的作品改成盲文出版。
The above limitations on rights shall be applicable also to the rights of publishers, performers, producers of sound recordings and video recordings, radio stations and television stations. 前款規(guī)定適用于對出版者、表演者、錄音錄像制作者、廣播電臺、電視臺的權利的限制。
Article 23 In compiling and publishing textbooks for implementing the nine-year compulsory education and the national educational program, parts of published works, short written works, music works or single copies of works of painting or photographic works may be compiled into textbooks without the authorization from the authors, except where the authors have declared in advance the use thereof is not permitted, with remuneration paid according to the regulations, the name of the author and the title of the work indicated and without prejudice to other rights enjoyed by the copyright owners according to this Law. 第二十三條 為實施九年制義務教育和國家教育規(guī)劃而編寫出版教科書,除作者事先聲明不許使用的外,可以不經著作權人許可,在教科書中匯編已經發(fā)表的作品片段或者短小的文字作品、音樂作品或者單幅的美術作品、攝影作品,但應當按照規(guī)定支付報酬,指明作者姓名、作品名稱,并且不得侵犯著作權人依照本法享有的其他權利。
The above limitations on rights shall be applicable also to the rights of publishers, performers, producers of sound recordings and video recordings, radio stations and television stations. 前款規(guī)定適用于對出版者、表演者、錄音錄像制作者、廣播電臺、電視臺的權利的限制。
Chapter III Copyright Licensing and Assignment Contracts 第三章 著作權許可使用和轉讓合同
Article 24 Subject to provisions in this Law according to which no permission is needed, anyone who exploits a work created by others shall conclude a contract with, or otherwise obtain permission from, the copyright owner. 第二十四條 使用他人作品應當同著作權人訂立許可使用合同,本法規(guī)定可以不經許可的除外。
A licensing contract shall include the following basic clauses: 許可使用合同包括下列主要內容:
(1) the category of right licensed for exploitation of the work covered by the license; (一)許可使用的權利種類;
(2) the exclusive or non-exclusive nature of the right to exploit the work covered by the license; (二)許可使用的權利是專有使用權或者非專有使用權;
(3) the geographic area and term of the license; (三)許可使用的地域范圍、期間;
(4) the standard of remuneration and the method of payment; (四)付酬標準和辦法;
(5) the liability in case of breach of the contract; and (五)違約責任;
(6) any other matter that the contracting parties consider necessary. (六)雙方認為需要約定的其他內容。
Article 25 Assignment of a right referred to in Article 10, paragraphs (5) to (17), of this Law shall require conclusion of a contract in writing. 第二十五條 轉讓本法第十條第一款第(五)項至第(十七)項規(guī)定的權利,應當訂立書面合同。
A contract of assignment shall include the following basic clauses: 權利轉讓合同包括下列主要內容:
(1) title of the work; (一)作品的名稱;
(2) category and geographic area of the assigned right; (二)轉讓的權利種類、地域范圍;
(3) assignment price; (三)轉讓價金;
(4) date and manner of payment of the assignment price; (四)交付轉讓價金的日期和方式;
(5) liabilities for breach of the contract; and (五)違約責任;
(6) any other matters that the contracting parties consider necessary. (六)雙方認為需要約定的其他內容。
Article 26 In case of a pledge over copyright, the pledgor and pledgee shall register the pledge concerned with the copyright administration department under the State Council. 第二十六條 以著作權出質的,由出質人和質權人向國務院著作權行政管理部門辦理出質登記。
Article 27 The other party shall not, without permission from the copyright owner, exercise any right that the copyright owner has not expressly licensed or assigned in the licensing and assignment contract. 第二十七條 許可使用合同和轉讓合同中著作權人未明確許可、轉讓的權利,未經著作權人同意,另一方當事人不得行使。
Article 28 The standard of remuneration for the exploitation of a work may be fixed by the interested parties or may be paid according to the standard established by the copyright administration department under the State Council in collaboration with other departments concerned. Where the interested parties have not expressly fixed it, remuneration may also be paid in accordance with the standard established by the copyright administration department under the State Council in collaboration with other departments concerned. 第二十八條 使用作品的付酬標準可以由當事人約定,也可以按照國務院著作權行政管理部門會同有關部門制定的付酬標準支付報酬。當事人約定不明確的,按照國務院著作權行政管理部門會同有關部門制定的付酬標準支付報酬。
Article 29 Publishers, performers, producers of sound recordings and video recordings, radio stations, television stations and other entities who or which have obtained, pursuant to the relevant provisions of this Law, the right to exploit the copyright of others, shall not prejudice the authors' rights of authorship, alteration or integrity, or their right to remuneration. 第二十九條 出版者、表演者、錄音錄像制作者、廣播電臺、電視臺等依照本法有關規(guī)定使用他人作品的,不得侵犯作者的署名權、修改權、保護作品完整權和獲得報酬的權利。
Chapter IV Publication, Performance, Sound Recording, Video Recording and Broadcasting 第四章 出版、表演、錄音錄像、播放
Section 1 Publication of Books, Newspapers and Periodicals 第一節(jié) 圖書、報刊的出版
Article 30 A book publisher who publishes a book shall conclude a publishing contract with, and pay remuneration to, the copyright owner. 第三十條 圖書出版者出版圖書應當和著作權人訂立出版合同,并支付報酬。
Article 31 A book publisher shall have the exclusive right to publish the work delivered to him by the copyright owner for publication. The exclusive right to publish a work enjoyed by the book publisher specified in the contract shall be protected by law, and the work may not be published by others. 第三十一條 圖書出版者對著作權人交付出版的作品,按照合同約定享有的專有出版權受法律保護,他人不得出版該作品。
Article 32 The copyright owner shall deliver the work within the term specified in the contract. The book publisher shall publish the work in accordance with the quality requirements and within the term specified in the contract. 第三十二條 著作權人應當按照合同約定期限交付作品。圖書出版者應當按照合同約定的出版質量、期限出版圖書。
The book publisher shall bear the civil liability specified in Article 53 of this Law if he fails to publish the work within the term specified in the contract. 圖書出版者不按照合同約定期限出版,應當依照本法第五十四條的規(guī)定承擔民事責任。
The book publisher shall notify, and pay remuneration to, the copyright owner when the work is to be reprinted or republished. If the publisher refuses to reprint or republish the work when stocks of the book are exhausted, the copyright owner shall have the right to terminate the contrast. 圖書出版者重印、再版作品的,應當通知著作權人,并支付報酬。圖書脫銷后,圖書出版者拒絕重印、再版的,著作權人有權終止合同。
Article 33 Where a copyright owner has submitted the manuscript of his work to a newspaper or a periodical publisher for publication and has not received, within 15 days from the newspaper publisher or within 30 days from the periodical publisher, counted from the date of submission of the manuscript, any notification of the said publisher's decision to publish the work, the copyright owner may submit the manuscript of the same work to another newspaper or periodical publisher for publication, unless the two parties have agreed otherwise. 第三十三條 著作權人向報社、期刊社投稿的,自稿件發(fā)出之日起十五日內未收到報社通知決定刊登的,或者自稿件發(fā)出之日起三十日內未收到期刊社通知決定刊登的,可以將同一作品向其他報社、期刊社投稿。雙方另有約定的除外。
Except where the copyright owner has declared that reprinting or excerpting is not permitted, other newspaper or periodical publishers may, after the publication of the work by a newspaper or periodical, reprint the work or print an abstract of it or print it as reference material, but such other publishers shall pay remuneration to the copyright owner as prescribed in regulations. 作品刊登后,除著作權人聲明不得轉載、摘編的外,其他報刊可以轉載或者作為文摘、資料刊登,但應當按照規(guī)定向著作權人支付報酬。
Article 34 A book publisher may alter or abridge a work with the permission of the copyright owner. 第三十四條 圖書出版者經作者許可,可以對作品修改、刪節(jié)。
A newspaper or periodical publisher may make editorial modifications and abridgements in a work, but shall not make modifications in the contents of the work unless permission has been obtained from the author. 報社、期刊社可以對作品作文字性修改、刪節(jié)。對內容的修改,應當經作者許可。
Article 35 When publishing works created by adaptation, translation, annotation, arrangement or compilation of preexisting works, the publisher shall both have the permission from, and pay remuneration to, the owners of the copyright in the works created by means of adaptation, translation, annotation, arrangement or compilation and the owners of the copyright in the original works. 第三十五條 出版改編、翻譯、注釋、整理、匯編已有作品而產生的作品,應當取得改編、翻譯、注釋、整理、匯編作品的著作權人和原作品的著作權人許可,并支付報酬。
Article 36 A publisher has the right to license or prohibit any other person to use the typographical arrangement of books or periodicals he has published. 第三十六條 出版者有權許可或者禁止他人使用其出版的圖書、期刊的版式設計。
The term of protection for the right provided for in the preceding paragraph shall be ten years, and expires on 3l December of the tenth year after the first publication of the books or periodicals using the typographical arrangement. 前款規(guī)定的權利的保護期為十年,截止于使用該版式設計的圖書、期刊首次出版后第十年的12月31日。
Section 2 Performance 第二節(jié) 表演
Article 37 A performer (an individual performer or a performing entity) who for a performance exploits a work created by another person shall obtain permission from, and pay remuneration to, the copyright owner. Where a performing organizer organizes a performance, the Organizer shall obtain permission from, and pay remuneration to, the copyright owner. 第三十七條 使用他人作品演出,表演者(演員、演出單位)應當取得著作權人許可,并支付報酬。演出組織者組織演出,由該組織者取得著作權人許可,并支付報酬。
When exploiting, for performance, works created by adaptation, translation, annotation, arrangement or compilation of preexisting works, the performer shall both have the permission from, and pay remuneration to, the owners of the copyright in the works created by means of adaptation, translation, annotation, arrangement or compilation and the owners of the copyright in the original works. 使用改編、翻譯、注釋、整理已有作品而產生的作品進行演出,應當取得改編、翻譯、注釋、整理作品的著作權人和原作品的著作權人許可,并支付報酬。
Article 38 A performer shall, in relation to his performance, enjoy the right: 第三十八條 表演者對其表演享有下列權利:
(2) to claim performer ship; (一)表明表演者身份;
(2) to protect the image inherent in his performance from distortion; (二)保護表演形象不受歪曲;
(3) to authorize others to make live broadcasts and public transmission of its or his performance and to receive remuneration; (三)許可他人從現場直播和公開傳送其現場表演,并獲得報酬;
(4) to authorize others to make sound recordings and video recordings, and to receive remuneration therefore; (四)許可他人錄音錄像,并獲得報酬;
(5) to authorize others to reproduce or distribute sound recordings and video recordings incorporating his performance, and to receive remuneration therefore; and (五)許可他人復制、發(fā)行錄有其表演的錄音錄像制品,并獲得報酬;
(6) to authorize others to communicate his performance to the public on information network, and to receive remuneration therefore. (六)許可他人通過信息網絡向公眾傳播其表演,并獲得報酬。
The person so authorized who exploits the work in the way referred to in the preceding paragraphs (3) to (6) shall obtain permission from, and pay remuneration to, the copyright owner. 被許可人以前款第(三)項至第(六)項規(guī)定的方式使用作品,還應當取得著作權人許可,并支付報酬。
Article 39 The term of protection for the rights provided for in Article 37, paragraphs (1) and (2), of this Law shall not be subject to any limitation. 第三十九條 本法第三十八條第一款第(一)項、第(二)項規(guī)定的權利的保護期不受限制。
The term of protection for the rights provided for in Article 37, paragraphs (3) to (6), of this Law shall be fifty years, and expires on 31 December of the fiftieth year after the performance was made. 本法第三十八條第一款第(三)項至第(六)項規(guī)定的權利的保護期為五十年,截止于該表演發(fā)生后第五十年的12月31日。
Section 3 Sound Recordings and Video Recordings 第三節(jié) 錄音錄像
a sound recording or video recording, exploits a work created by another person, shall obtain permission from, and pay remuneration to, the copyright owner. 第四十條 錄音錄像制作者使用他人作品制作錄音錄像制品,應當取得著作權人許可,并支付報酬。
A producer of sound recordings or video recordings who exploits a work created by adaptation, translation, annotation or arrangement of a preexisting work shall both obtain permission from, and pay remuneration to the owner of the copyright in the work created by adaptation, translation, annotation or arrangement and to the owner of the copyright in the original work. 錄音錄像制作者使用改編、翻譯、注釋、整理已有作品而產生的作品,應當取得改編、翻譯、注釋、整理作品的著作權人和原作品著作權人許可,并支付報酬。
A producer of sound recordings who exploits a music work another person has duly made into a sound recording to produce sound recordings, may not obtain permission from, but shall pay remuneration to the copyright owner as prescribed by regulat1ons, such Work shall not be exploited where the copyright owner has declared that such exploitation is not permitted. 錄音制作者使用他人已經合法錄制為錄音制品的音樂作品制作錄音制品,可以不經著作權人許可,但應當按照規(guī)定支付報酬;著作權人聲明不許使用的不得使用。
Article 41 When producing sound recording or video recording, the producer shall conclude a contract with the performers and pay remuneration to the performers. 第四十一條 錄音錄像制作者制作錄音錄像制品,應當同表演者訂立合同,并支付報酬。
Article 42 A producer of sound recordings or video recordings shall have the right to authorize others to reproduce, distribute, rent and communicate to the public on an information network such sound recordings or video recordings and the right to obtain remuneration therefore. The term of protection of such rights shall be fifty years, and expires on 3l December of the fiftieth year after the recording was first produced. 第四十二條 錄音錄像制作者對其制作的錄音錄像制品,享有許可他人復制、發(fā)行、出租、通過信息網絡向公眾傳播并獲得報酬的權利;權利的保護期為五十年,截止于該制品首次制作完成后第五十年的12月31日。
Any one who is authorized to reproduce, distribute and communicate to the public on an information network a sound recording or video recording shall also obtain permission from, and pay remuneration to, the copyright owner and the performer as presented by regulations. 被許可人復制、發(fā)行、通過信息網絡向公眾傳播錄音錄像制品,還應當取得著作權人、表演者許可,并支付報酬。
Section 4 Broadcasting by Radio Stations or Television Stations 第四節(jié) 廣播電臺、電視臺播放
Article 43 A radio station or television station that broadcasts an unpublished work created by another person, shall obtain permission from, and pay remuneration to, the copyright owner. 第四十三條 廣播電臺、電視臺播放他人未發(fā)表的作品,應當取得著作權人許可,并支付報酬。
A radio station or television station that broadcasts a published work created by another person does not need a permission from, but shall pay remuneration to, the copyright owner. 廣播電臺、電視臺播放他人已發(fā)表的作品,可以不經著作權人許可,但應當支付報酬。
Article 44 A radio station or television station that broadcasts a published sound recording, does not need a permission from, but shall pay remuneration to, the copyright owner, except that the interested parties have agreed otherwise. The specific procedures for treating the matter shall be established by the State Council. 第四十四條 廣播電臺、電視臺播放已經出版的錄音制品,可以不經著作權人許可,但應當支付報酬。當事人另有約定的除外。具體辦法由國務院規(guī)定。
Article 45 A radio station or television station shall have the right to prohibit the following acts without authorization therefrom: 第四十五條 廣播電臺、電視臺有權禁止未經其許可的下列行為:
(1) to rebroadcast its broadcast radio or television program; and (一)將其播放的廣播、電視轉播;
(2) to fix its broadcast radio or television program on a sound recording or video recording carrier and to reproduce the sound recording or video recording carrier. (二)將其播放的廣播、電視錄制在音像載體上以及復制音像載體。
The term of protection for the right referred to in the preceding paragraph shall be fifty years, and expires on 31 December of the fiftieth year after the radio or television program was first broadcast. 前款規(guī)定的權利的保護期為五十年,截止于該廣播、電視首次播放后第五十年的12月31日。
Article 46 A television station that broadcasts a cinematographic work, a work created by virtue of an analogous method of film production or a video graphic work produced by another person shall obtain permission from, and pay remuneration to, the producer of the cinematographic or video graphic work; the station that broadcasts a video graphic work produced by another person shall obtain permission of, and pay remuneration to, the copyright owner. 第四十六條 電視臺播放他人的電影作品和以類似攝制電影的方法創(chuàng)作的作品、錄像制品,應當取得制片者或者錄像制作者許可,并支付報酬;播放他人的錄像制品,還應當取得著作權人許可,并支付報酬。
Chapter V Legal Liabilities and Enforcement Measures 第五章 法律責任和執(zhí)法措施
Article 47 Anyone who commits any of the following acts of infringement shall bear civil liability for such remedies as ceasing the infringing act, eliminating the effects of the act, making an apology or paying compensation for damages, depending on the circumstances: 第四十七條 有下列侵權行為的,應當根據情況,承擔停止侵害、消除影響、賠禮道歉、賠償損失等民事責任:
(1) publishing a work without the permission of the copyright owner; (一)未經著作權人許可,發(fā)表其作品的;
(2) publishing a work of joint authorship as a work created solely by oneself, without the permission of the other co-authors; (二)未經合作作者許可,將與他人合作創(chuàng)作的作品當作自己單獨創(chuàng)作的作品發(fā)表的;
(3) having one's name mentioned in connection with a work created by another, in order to seek personal fame and gain, where one has not taken part in the creation of the work; (三)沒有參加創(chuàng)作,為謀取個人名利,在他人作品上署名的;
(4) distorting or mutilating a work created by another; (四)歪曲、篡改他人作品的;
(5) plagiarizing a work of another person; (五)剽竊他人作品的;
(6) exploiting by exhibition, film production or any analogous method of film production, or by adaptation, translation, annotation, or by other means, without the permission of the copyright owner, unless otherwise provided in this Law; (六)未經著作權人許可,以展覽、攝制電影和以類似攝制電影的方法使用作品,或者以改編、翻譯、注釋等方式使用作品的,本法另有規(guī)定的除外;
(7) exploiting a work created by another person without paying remuneration as prescribed by regulations; (七)使用他人作品,應當支付報酬而未支付的;
(8) rending a work, sound recording or video recording, without the permission of the copyright owner of a cinematographic work, a work created by virtue of an analogous method of film production, computer software, sound recording or video recording or the owner of a copyright-related right unless otherwise provided in this Law; (八)未經電影作品和以類似攝制電影的方法創(chuàng)作的作品、計算機軟件、錄音錄像制品的著作權人或者與著作權有關的權利人許可,出租其作品或者錄音錄像制品的,本法另有規(guī)定的除外;
(9) exploiting the typographic arrangement of a book or periodical without the permission of the publisher. (九)未經出版者許可,使用其出版的圖書、期刊的版式設計的;
(10) broadcasting live a performance or communicating the live performance to the public, or recording his performance without the permission of the performer; or (十)未經表演者許可,從現場直播或者公開傳送其現場表演,或者錄制其表演的;
(11) committing any other act of infringement of copyright and of other rights and interests relating to copyright. (十一)其他侵犯著作權以及與著作權有關的權益的行為。
Article 48 Anyone who commits any of the following acts of infringement shall bear civil liability for such remedies as ceasing the infringing act, eliminating the effects of the act, making an apology or paying damages, depending on the circumstances' and may, in addition, be subjected by a copyright administration department to such administrative penalties as ceasing the infringing act, confiscating unlawful income from the act, confiscating and destroying infringing reproductions and imposing a fine; where the circumstances are serious, the copyright administration department may also confiscate the materials, tools, and equipment mainly used for making the infringing reproductions; and if the act constitutes a crime, the infringer shall be prosecuted for his criminal liability: 第四十八條 有下列侵權行為的,應當根據情況,承擔停止侵害、消除影響、賠禮道歉、賠償損失等民事責任;同時損害公共利益的,可以由著作權行政管理部門責令停止侵權行為,沒收違法所得,沒收、銷毀侵權復制品,并可處以罰款;情節(jié)嚴重的,著作權行政管理部門還可以沒收主要用于制作侵權復制品的材料、工具、設備等;構成犯罪的,依法追究刑事責任:
(1) reproducing, distributing, performing, showing, broadcasting, compiling or communicating to the public on an information network a work created by another person, without the permission of the copyright owner, unless otherwise provided in this Law; (一)未經著作權人許可,復制、發(fā)行、表演、放映、廣播、匯編、通過信息網絡向公眾傳播其作品的,本法另有規(guī)定的除外;
(2) publishing a book where the exclusive right of publication belongs to another person; (二)出版他人享有專有出版權的圖書的;
(3) reproducing and distributing a sound recording or video recording of a performance, or communicating to the public his performance on an information network without the permission of the performer, unless otherwise provided in the Law; (三)未經表演者許可,復制、發(fā)行錄有其表演的錄音錄像制品,或者通過信息網絡向公眾傳播其表演的,本法另有規(guī)定的除外;
(4) reproducing and distributing or communicating to the public on an information network a sound recording or video recording produced by another person, without the permission of the producer, unless otherwise provided in the Law; (四)未經錄音錄像制作者許可,復制、發(fā)行、通過信息網絡向公眾傳播其制作的錄音錄像制品的,本法另有規(guī)定的除外;
(5) broadcasting and reproducing a radio or television program produced by a radio station or television station without the permission of the radio station or television station, unless otherwise provided in this Law; (五)未經許可,播放或者復制廣播、電視的,本法另有規(guī)定的除外;
(6) intentionally circumventing or destroying the technological measures taken by a right holder for protecting the copyright or copyright-related rights in his work, sound recording or video recording, without the permission of the copyright owner, or the owner of the copyright-related rights, unless otherwise provided in law or in administrative regulations; (六)未經著作權人或者與著作權有關的權利人許可,故意避開或者破壞權利人為其作品、錄音錄像制品等采取的保護著作權或者與著作權有關的權利的技術措施的,法律、行政法規(guī)另有規(guī)定的除外;
(7) intentionally deleting or altering the electronic right management information of a work, sound recording or video recording, without the permission of the copyright owner or the owner of a copyright-related right, unless otherwise provided in law or in administrative regulations; or (七)未經著作權人或者與著作權有關的權利人許可,故意刪除或者改變作品、錄音錄像制品等的權利管理電子信息的,法律、行政法規(guī)另有規(guī)定的除外;
(8) producing or selling a work where the signature of another is counterfeited. (八)制作、出售假冒他人署名的作品的。
Article 49 Where a copyright or a copyright-related right is infringed, the infringer shall compensate for the actually injury suffered by the right holder; where the actual injury is difficult to compute, the damages shall be paid on the basis of the unlawful income of the infringer. The amount of damages shall also include the appropriate fees paid by the right holder to stop the infringing act. 第四十九條 侵犯著作權或者與著作權有關的權利的,侵權人應當按照權利人的實際損失給予賠償;實際損失難以計算的,可以按照侵權人的違法所得給予賠償。賠償數額還應當包括權利人為制止侵權行為所支付的合理開支。
Where the right holder's actual injury or infringer's Unlawful income cannot be determined, the People's Court shall Judge the damages not exceeding RMB 500, 00 depending on the circumstances of the infringing act. 權利人的實際損失或者侵權人的違法所得不能確定的,由人民法院根據侵權行為的情節(jié),判決給予五十萬元以下的賠償。
Article 50 A copyright owner or owner of a copyright-related right who has evidence to establish that another person is committing or will commit an act of infringing his right, which could cause irreparable injury to his legitimate rights and interests if the act is not stopped immediately, may apply to the People's Court for ordering cessation of the related act and for taking the measures for property preservation before instituting legal proceedings. 第五十條 著作權人或者與著作權有關的權利人有證據證明他人正在實施或者即將實施侵犯其權利的行為,如不及時制止將會使其合法權益受到難以彌補的損害的,可以在起訴前向人民法院申請采取責令停止有關行為和財產保全的措施。
The provisions of Articles 93 to 96 and 99 of the Civil Procedure Law of the People's Republic of China shall apply when the People's Court handles the application referred to in the preceding paragraph. 人民法院處理前款申請,適用《中華人民共和國民事訴訟法》第九十三條至第九十六條和第九十九條的規(guī)定。
Article 51 For the purpose of preventing an infringing act and under the circumstance where the evidence could be lost or is difficult to obtain at1erwards, the copyright owner or the owner of a copyright-related right may apply to the People's Court for evidence preservation before initiating legal proceedings. 第五十一條 為制止侵權行為,在證據可能滅失或者以后難以取得的情況下,著作權人或者與著作權有關的權利人可以在起訴前向人民法院申請保全證據。
The People's Court must make the decision within forty-eight hours after it accepts an application; the measures of preservation shall be taken without delay if it is decided to do so. 人民法院接受申請后,必須在四十八小時內作出裁定;裁定采取保全措施的,應當立即開始執(zhí)行。
The People's Court may order the applicant to provide a guaranty, if the latter fails to do so, the Court shall reject the application. 人民法院可以責令申請人提供擔保,申請人不提供擔保的,駁回申請。
Where the applicant fails to institute legal proceedings within fifteen days after the People's Court adopted the measures of preservation, the latter shall terminate the measures of preservation. 申請人在人民法院采取保全措施后十五日內不起訴的,人民法院應當解除保全措施。
Article 52 The People's Court hearing a case may confiscate the unlawful income, infringing reproductions and materials used for committing the illegal act of infringement of copyright or copyright-related rights. 第五十二條 人民法院審理案件,對于侵犯著作權或者與著作權有關的權利的,可以沒收違法所得、侵權復制品以及進行違法活動的財物。
Article 53 The publisher or producer of a reproduction who cannot prove that his publication or production has been authorized, the distributor of a reproduction or the renter of the reproduction of a cinematographic work, a work created by virtue of an analogous method of film production, computer software, sound recording or video recording who cannot prove that his distributed or rented reproduction has been from a lawful source, shall bear legal liability. 第五十三條 復制品的出版者、制作者不能證明其出版、制作有合法授權的,復制品的發(fā)行者或者電影作品或者以類似攝制電影的方法創(chuàng)作的作品、計算機軟件、錄音錄像制品的復制品的出租者不能證明其發(fā)行、出租的復制品有合法來源的,應當承擔法律責任。
Article 54 A party who fails to fulfill his contractual obligations, or executes them in a manner that is not in conformity with the agreed conditions of the contract, shall bear civil liability in accordance with the relevant provisions of the General Principles of the Civil Law of the People's Republic of China, the Contract Law of the People's Republic of China and other relevant laws and regulations. 第五十四條 當事人不履行合同義務或者履行合同義務不符合約定條件的,應當依照《中華人民共和國民法通則》、《中華人民共和國合同法》等有關法律規(guī)定承擔民事責任。
Article 55 A dispute over copyright may be settle by mediation. lt may also be submitted for arbitration to a copyright arbitration body under a written arbitration agreement concluded between the parties or under the arbitration clause in the contract. 第五十五條 著作權糾紛可以調解,也可以根據當事人達成的書面仲裁協(xié)議或者著作權合同中的仲裁條款,向仲裁機構申請仲裁。
Any party may institute proceedings directly in the People's Court in the absence of a written arbitration agreement or in the absence of an arbitration clause in the contract. 當事人沒有書面仲裁協(xié)議,也沒有在著作權合同中訂立仲裁條款的,可以直接向人民法院起訴。
Article 56 Any party who is not satisfied with an administrative penalty may institute proceedings in the People's Court within three months from the date of receipt of the written decision on the penalty. If a party neither institutes legal proceedings nor implements the decision within the time limit, the copyright administration department concerned may apply to the People's Court for enforcement. 第五十六條 當事人對行政處罰不服的,可以自收到行政處罰決定書之日起三個月內向人民法院起訴,期滿不起訴又不履行的,著作權行政管理部門可以申請人民法院執(zhí)行。
Chapter VI Supplementary Provisions 第六章 附則
Article 57 For the purposes of this Law, the terms "zhuzuoquan(著作權)" is "banquan(版權)". 第五十七條 本法所稱的著作權即版權。
Article 58 "publication" referred to in Article 2 of this Law means the reproduction and distribution of a work. 第五十八條 本法第二條所稱的出版,指作品的復制、發(fā)行。
Article 59 Regulations for the protection of computer software and the right of communication of information on network shall be established separately by the State Council. 第五十九條 計算機軟件、信息網絡傳播權的保護辦法由國務院另行規(guī)定。
Article 60 The rights of copyright owners, publishers, performers, producers of sound recordings and video recordings, radio stations and television' stations as provided for in this Law, of which the term of protection specified in this Law has not yet expired on the date of this Law's entry into force, shall be protected in accordance with this Law. 第六十條 本法規(guī)定的著作權人和出版者、表演者、錄音錄像制作者、廣播電臺、電視臺的權利,在本法施行之日尚未超過本法規(guī)定的保護期的,依照本法予以保護。
Any infringements of copyright and the copyright-related rights or breaches of contract committed prior to the entry into force of this Law shall be dealt with under the relevant regulations or policies in force at the time when the act was committed. 本法施行前發(fā)生的侵權或者違約行為,依照侵權或者違約行為發(fā)生時的有關規(guī)定和政策處理。
Article 61 This Law shall enter into force on June 1, 1991. 第六十一條 本法自1991年6月1日起施行。
